TERMS OF SERVICE

General Terms and Conditions of Sale, Shipping, Delivery and Right of Withdrawal

1. Seller Information

The products presented and marketed through the website www.infinito-italian-atelier.com are sold by:

Infinito Italian Bath Atelier is a trademark of La Collina S.r.l., which also owns the Hidrospace trademark.

The sale of the products, order management, invoicing, collection of payments, organisation of shipments and management of after-sales assistance are carried out by La Collina S.r.l., unless otherwise stated in the quotation, order confirmation or documentation relating to the individual purchase.


2. Scope of Application

These terms and conditions govern purchases made through the Infinito Italian Bath Atelier website, by email, telephone, messaging services or by accepting a quotation prepared by La Collina S.r.l.

Placing an order, paying the deposit or accepting the quotation implies that the customer has read and accepted these terms and conditions, without prejudice to any special conditions expressly agreed in writing.

In the event of any conflict between these general terms and conditions and the provisions stated in the quotation or order confirmation, the conditions specifically agreed for the individual purchase shall prevail, subject to the mandatory provisions protecting consumers.


3. Products and Characteristics

The customer may purchase the products displayed on the website or request a personalised quotation by contacting La Collina S.r.l. directly.

The images, settings, renderings, videos and graphic representations displayed on the website are mainly for illustrative purposes.

Colour tones, veining, finishes, proportions and certain aesthetic details may appear different depending on:

  • the screen used;

  • lighting conditions;

  • the natural characteristics of the materials;

  • production processes;

  • the selected configuration;

  • the accessories chosen by the customer;

  • the characteristics of the individual product.

The actual characteristics of the product are those stated in the technical data sheet, quotation and order confirmation sent to the customer.

Before confirming the order, the customer must carefully check the dimensions, configuration, colour, finishes, whirlpool system, accessories and all other characteristics stated in the contractual documentation.


4. Customised and Made-to-Order Products

Many products marketed through Infinito Italian Bath Atelier may be manufactured, modified or configured according to the customer’s specific requirements.

The following may constitute customisation, by way of example:

  • selection of dimensions;

  • modification of standard dimensions;

  • selection of panels;

  • configuration of the whirlpool system;

  • positioning of accessories;

  • selection of taps and fittings;

  • inclusion of chromotherapy or additional systems;

  • selection of finishes, colours or materials;

  • selection of the position of drains, controls or components;

  • any work specifically requested by the customer.

The customised or made-to-order nature of the product will be indicated in the quotation, order confirmation or related contractual documentation.

For goods made to measure or clearly customised, the exclusion from the right of withdrawal provided for by applicable law shall apply.


5. Purchase Methods

The customer may make a purchase:

  • directly through the website;

  • by sending a request by email;

  • by telephone;

  • through messaging services;

  • by accepting a written quotation;

  • through any other method indicated by La Collina S.r.l.

The order shall be considered definitively accepted only after written confirmation by La Collina S.r.l. and, where applicable, after receipt of the deposit.

La Collina S.r.l. reserves the right to request any further information necessary for the correct performance of the order.

If the product is unavailable or a particular configuration cannot be supplied, the customer will be informed promptly and may:

  • accept an alternative solution;

  • agree on a different configuration;

  • wait for the product to become available;

  • request the return of any amounts already paid, if the order cannot be fulfilled.


6. Prices

The applicable prices are those displayed on the website or stated in the quotation or order confirmation.

Before purchasing, the customer must check whether the stated price includes:

  • VAT;

  • packaging;

  • shipping;

  • insurance;

  • unloading;

  • handling;

  • delivery to upper floors;

  • installation;

  • accessories;

  • additional work;

  • any additional services.

Unless expressly stated otherwise, shipping, delivery, unloading, handling and installation costs are not included in the product price.

For purchases destined for countries other than Italy, additional costs, local taxes, customs duties, customs clearance charges or other fees may apply. These will be stated or agreed in relation to the individual order.


7. Payment Methods

Unless otherwise stated in the quotation or order confirmation, payment shall be made as follows:

  • 30% of the total price as a deposit when the order is confirmed;

  • 70% as the balance before shipment and, in any event, when the product is ready for loading.

Production, customisation or preparation of the product may begin only after the deposit has actually been credited.

Shipment may be suspended until the balance has actually been credited.

Payments may be made by:

  • bank transfer;

  • PayPal, where available;

  • payment card, where available;

  • any other expressly agreed method.

Bank details and payment instructions will be communicated during the purchasing process or stated in the quotation and order confirmation.

Any arrangement for payment on delivery or directly to the carrier must be set out in a specific written agreement and does not constitute the standard payment method.


SHIPPING AND DELIVERY

8. Shipping within Italy

For deliveries within Italy, shipping costs shall be those stated during the purchasing process, in the quotation or in the order confirmation.

Shipping costs may vary depending on:

  • product dimensions;

  • weight;

  • number of packages;

  • destination;

  • product characteristics;

  • need for special packaging;

  • transport method;

  • need for special vehicles.

The actual shipping cost will be communicated and confirmed before the order is concluded.

For the following destinations, shipping will be carried out only after a specific quotation has been issued:

  • Sicily;

  • Sardinia;

  • smaller islands;

  • remote locations;

  • restricted traffic zones;

  • mountain areas;

  • destinations with particular access difficulties;

  • destinations requiring special vehicles or services.

Different rates may apply to shower enclosures, shower trays, bath panels, accessories, taps and fittings and smaller products.


9. International Shipping

Shipping costs and methods for countries other than Italy shall always be determined through a specific quotation and must be expressly accepted by the customer.

International shipping costs may depend on:

  • country and place of destination;

  • product weight and dimensions;

  • number of packages;

  • need for special packaging;

  • insurance;

  • unloading methods;

  • transport method;

  • customs procedures;

  • duties, taxes and import costs;

  • logistical restrictions or difficulties.

International shipment will take place only after the customer has accepted the relevant conditions and paid the required amounts.

Any customs duties, import taxes, customs clearance fees and other charges imposed by the authorities of the country of destination shall be borne by the customer, unless otherwise agreed in writing.

The financial conditions relating to international shipping, islands and special destinations shall therefore be agreed separately for each order.


10. Transport Methods

Unless otherwise agreed in writing, shipment shall be entrusted to a carrier selected by La Collina S.r.l.

Where La Collina S.r.l. organises transport for a consumer, the risk of loss of or damage to the goods remains with the seller until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the product.

Where, however, the carrier is independently chosen and directly appointed by the customer outside the options proposed by the seller, the risk passes to the customer when the goods are delivered to the carrier, within the limits permitted by applicable law.


11. Production and Delivery Times

Production, preparation and delivery times are stated in the quotation, order confirmation or product sheet.

Any stated deadlines shall be considered indicative unless expressly described in writing as essential.

Times may vary depending on:

  • product availability;

  • work requested;

  • customisation;

  • availability of materials and components;

  • time of year;

  • destination;

  • transport methods;

  • complexity of the order;

  • force majeure events.

La Collina S.r.l. shall not be liable for delays caused by circumstances not directly attributable to the company, including, by way of example:

  • delays by suppliers;

  • temporary unavailability of materials or components;

  • strikes;

  • traffic blockages;

  • adverse weather conditions;

  • measures adopted by public authorities;

  • natural events;

  • wars;

  • emergencies;

  • travel restrictions;

  • customs difficulties;

  • inability or delay on the part of the carrier;

  • interruptions or slowdowns in production activities not attributable to the company.

Any delay will be communicated to the customer as soon as reasonably possible.


12. Kerbside Delivery

Unless otherwise agreed in writing, transport includes delivery of the product only at kerbside level, in a location accessible to the carrier’s vehicle.

The following are not included:

  • manual unloading;

  • transport inside the property;

  • delivery to upper floors;

  • use of cranes, truck-mounted cranes or platforms;

  • handling services;

  • removal of doors, windows or frames;

  • movement within the property;

  • assembly;

  • installation;

  • connection to systems;

  • disposal of packaging;

  • collection or disposal of the replaced product.

Any additional services must be requested before the order is confirmed and will be subject to a separate quotation.

The customer must check in advance:

  • whether the carrier’s vehicle can access the location;

  • whether sufficient space is available for unloading;

  • the dimensions of doors, stairs, lifts and passageways;

  • the absence of obstacles;

  • whether any permits are required;

  • the availability of people or equipment needed to receive and move the product.

Any costs resulting from failed delivery caused by incorrect information, absence of the recipient, insufficient space or lack of access shall be borne by the customer.


13. Inspection of Goods upon Delivery

Upon delivery, the customer must check:

  • the number of packages;

  • correspondence with the transport document;

  • integrity of the packaging;

  • absence of impacts;

  • absence of openings;

  • absence of crushing;

  • absence of water damage;

  • absence of visible damage.

If any anomaly is found, the customer must record a specific reservation on the carrier’s document, accurately describing the damage or irregularity observed.

The generic wording “accepted subject to inspection” alone is not sufficient.

The reservation must specifically describe the condition of the packaging or goods. For example:

“Packaging damaged on the right-hand side, cardboard crushed and wrapping open.”

The customer is advised to photograph:

  • the packaging before opening;

  • every side of the packaging;

  • the shipping label;

  • any visible damage;

  • the product after opening;

  • the document on which the reservation was recorded.

The anomaly must be reported promptly to La Collina S.r.l. at info@hidrospacegroup.com, enclosing photographs and a copy of the transport document.

Failure to record a specific reservation may make it more difficult to establish that the damage occurred during transport, without prejudice to the mandatory protections granted to consumers.


14. Installation

La Collina S.r.l. does not install the products unless the service has been expressly included in the quotation or order confirmation.

Installation must be carried out by professionally qualified personnel in compliance with:

  • the manufacturer’s instructions;

  • applicable technical regulations;

  • requirements relating to electrical and plumbing systems;

  • the instructions contained in the manuals;

  • the characteristics of the installation site;

  • safety rules;

  • any local regulations.

Before purchasing, the customer must ask their own technician to verify the suitability of:

  • spaces;

  • systems;

  • drains;

  • connections;

  • electrical arrangements;

  • plumbing arrangements;

  • structural load capacity;

  • the conditions required for installation and use of the product.

La Collina S.r.l. shall not be liable for damage resulting from incorrect assembly, non-compliant installation, tampering, unauthorised modification or use contrary to the instructions.


RIGHT OF WITHDRAWAL

15. Consumers

The right of withdrawal set out in this section is granted exclusively to the consumer, meaning a natural person who purchases for purposes unrelated to their business, commercial, craft or professional activity.

The right of withdrawal does not automatically apply to purchases made by:

  • companies;

  • businesses;

  • professionals;

  • craftspeople;

  • retailers;

  • commercial operators;

  • persons acting within their professional or business activity.


16. Deadline for Exercising the Right of Withdrawal

Subject to the exclusions provided by law, the consumer may withdraw from the contract without giving any reason within 14 days from the day on which they acquire physical possession of the product.

In the case of multiple goods ordered in one order and delivered separately, the period begins on the day on which the last item is delivered.

In the case of goods consisting of multiple lots or pieces, the period begins on the day on which the consumer acquires physical possession of the last lot or piece.

The right of withdrawal must not be confused with the legal guarantee covering any lack of conformity of the product.


17. Notice of Withdrawal

To exercise the right of withdrawal, the consumer must send an explicit statement containing at least:

  • first name and surname;

  • address;

  • email address;

  • order number;

  • product purchased;

  • order date;

  • date on which the product was received;

  • declaration of the intention to withdraw from the contract.

The notice must be sent to:

The consumer may use the standard withdrawal form included at the end of this document but is not required to do so.

The notice shall be considered submitted within the deadline if it is sent before the withdrawal period expires.


18. Return of Products

The consumer must return the product within 14 days from the date on which they communicated their decision to withdraw from the contract.

The return must be agreed in advance with La Collina S.r.l. so that the address and return method most appropriate to the nature, dimensions and weight of the product can be determined.

Unless otherwise required by law or agreed in writing, the direct costs of returning the goods shall be borne by the customer.

Given the dimensions and weight of baths, mini-pools and other products marketed, the return cost may be substantial and may not be the same as the original delivery cost.

The product must be returned:

  • complete with all its parts;

  • complete with accessories;

  • complete with documentation;

  • adequately protected and packaged;

  • preferably in its original packaging;

  • without damage other than that resulting from normal inspection of the goods.

The consumer shall be liable for any reduction in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

The customer is responsible for correctly preparing the product for return transport.


19. Refund

Where the right of withdrawal has been validly exercised, La Collina S.r.l. shall refund the payments received from the consumer, including any standard delivery costs paid, within 14 days from the date on which it was informed of the consumer’s decision to withdraw from the contract.

Any additional costs resulting from the customer’s choice of a delivery method other than the least expensive standard delivery method offered by the seller shall not be refunded.

The refund may be withheld until the product has been received or until the consumer provides evidence that it has been returned, whichever occurs first.

The refund shall be made using the same means of payment used for the purchase, unless otherwise expressly agreed with the consumer and provided that the consumer does not incur any additional costs.

Any reduction in the value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning may be deducted from the amount refunded.


20. Exclusions from the Right of Withdrawal

The right of withdrawal is excluded in the cases provided for by applicable law and, in particular, in relation to the supply of:

  • goods made to measure;

  • clearly customised goods;

  • products manufactured according to dimensions supplied by the customer;

  • products manufactured using colours, finishes or materials specifically selected by the customer;

  • products manufactured according to configurations requested by the customer;

  • products modified from their standard configuration;

  • products manufactured or assembled specifically according to the customer’s requirements;

  • any other goods for which applicable law excludes the right of withdrawal.

By way of example, the right of withdrawal may be excluded where the customer has requested:

  • special dimensions;

  • structural modifications;

  • a specific configuration of the whirlpool system;

  • special panels;

  • specific colours or finishes;

  • accessories installed in a specified position;

  • changes to drains or controls;

  • work not included in the standard configuration.

The exclusion must result from the nature of the product and the information provided to the customer before purchase.

Opening the packaging alone does not automatically result in the loss of the right of withdrawal, without prejudice to the seller’s right to assess any reduction in value caused by handling exceeding what is necessary to establish the nature, characteristics and functioning of the goods.


LEGAL GUARANTEE AND ASSISTANCE

21. Legal Guarantee of Conformity

Products sold to consumers are covered by the legal guarantee of conformity provided for under consumer protection law.

For new products, La Collina S.r.l. is liable to the consumer for any lack of conformity existing at the time of delivery and becoming apparent within two years from delivery of the product.

Where a lack of conformity exists, the consumer is entitled to the remedies provided by applicable law, according to the conditions and order established by consumer protection legislation.

The legal guarantee does not cover problems or damage resulting from:

  • incorrect installation;

  • non-compliant assembly;

  • improper use;

  • failure to follow instructions;

  • tampering;

  • unauthorised modifications;

  • lack of maintenance;

  • incorrect maintenance;

  • ordinary wear and tear;

  • accidental damage;

  • impacts;

  • use of unsuitable products or cleaning agents;

  • limescale;

  • problems with the electrical or plumbing systems of the property;

  • voltage fluctuations;

  • frost;

  • insufficient ventilation;

  • unsuitable environmental conditions;

  • work carried out by unqualified personnel.

For purchases made by professionals, businesses or other persons who do not qualify as consumers, the provisions of the Italian Civil Code and any conventional warranties provided by the manufacturer shall apply.


22. Assistance and Spare Parts

Where technically possible, La Collina S.r.l. may handle the issue by sending spare parts or replacement components.

Spare parts must be installed by qualified personnel.

The supply of a spare part does not automatically mean that the labour required for its installation is included, unless this is required under the legal guarantee or has been expressly agreed.

The customer must allow La Collina S.r.l. to inspect the product and verify the nature of the reported defect.

La Collina S.r.l. may request:

  • photographs;

  • videos;

  • order number;

  • copy of the invoice;

  • product serial number;

  • detailed description of the problem;

  • installation documentation;

  • report from the installation technician;

  • any additional information necessary to identify the problem.

The customer must not carry out any unauthorised work, modifications or replacements where such actions may affect the inspection of the defect.


23. Complaints

Any complaints must be sent to:

The complaint must contain:

  • the customer’s first name and surname or company name;

  • order or invoice number;

  • identification of the product;

  • detailed description of the problem;

  • date on which the problem was identified;

  • photographs or videos;

  • any documentation from the installation technician;

  • contact details for communications.

La Collina S.r.l. will examine the complaint and inform the customer of any information or inspections required.


24. Customer Responsibilities

The customer is responsible for the accuracy and completeness of the information supplied for the performance of the order and delivery.

In particular, the customer must verify:

  • the accuracy of the dimensions;

  • the compatibility of the product with the available space;

  • the suitability of the systems;

  • the possibility of access and movement;

  • the accuracy of the delivery address;

  • the availability of a person authorised to receive the goods;

  • the compatibility of the selected configuration with their requirements.

La Collina S.r.l. shall not be liable for errors resulting from inaccurate or incomplete information supplied by the customer.


25. Force Majeure

La Collina S.r.l. shall not be liable for failure or delay in performing its obligations where this is caused by unforeseeable events or circumstances that cannot reasonably be controlled.

Such events include, by way of example:

  • natural disasters;

  • fires;

  • floods;

  • earthquakes;

  • epidemics or health emergencies;

  • wars;

  • civil unrest;

  • strikes;

  • measures adopted by public authorities;

  • transport blockages;

  • power outages;

  • exceptional unavailability of raw materials or components;

  • customs obstacles;

  • delays or operational impossibility affecting carriers.

In such circumstances, the performance deadlines shall be extended for the time necessary to overcome the impediment.


26. Applicable Law and Jurisdiction

These terms and conditions are governed by Italian law.

For disputes involving a consumer, the court of the consumer’s place of residence or domicile shall have jurisdiction, where such residence or domicile is located within the European Union, in accordance with applicable law.

For disputes involving professional customers, businesses, retailers or persons purchasing in the course of their business, commercial, craft or professional activity, the Court of Rimini shall have exclusive jurisdiction, unless otherwise agreed in writing.


27. Amendment and Updating of the Terms and Conditions

La Collina S.r.l. reserves the right to amend or update these terms and conditions at any time.

Any amendments shall take effect from the date on which they are published on the website and shall apply to orders concluded after that date.

Orders already concluded shall remain subject to the terms and conditions accepted by the customer at the time of purchase, except for amendments required by mandatory provisions of law.


28. Privacy

The customer’s personal data will be processed by La Collina S.r.l. for:

  • order management;

  • payment management;

  • production or preparation of the product;

  • delivery;

  • invoicing;

  • assistance;

  • management of complaints and returns;

  • compliance with legal obligations.

The Cookie Policy and Privacy Policy are separate documents from these terms and conditions.
